Surprise Billing and Transparency Mandates: What They Might Mean for Providers

“Surprise billing” refers to an unexpected charge that a patient receives after being treated by an out-of-network health care provider. At least 25 states have implemented measures to address surprise billing, and both chambers of Congress are now actively pursuing a legislative fix at the federal level. Further, this summer, the White House issued an executive order directing the Department of Health and Human Services to require hospitals to post standard charge information to the public, including information about their negotiated rates. Therefore, providers are now anticipating proposed federal rules about what these “transparency” requirements might actually entail. Both of these measures have the potential to significantly impact providers, reimbursement and patient experience.
