Physician Contracting: An Ounce of Prevention Is Worth a Ton of Cure

The government continues to actively (and successfully) pursue fraud and abuse within the United States health care system. Combined with the growing number of employment, medical director, space lease and other financial relationships between hospitals and physicians, the attention and scrutiny on physician-hospital arrangements and contracts continues to increase. Improperly structured or neglected contracts expose hospitals and health systems to substantial civil monetary penalties. In response, hospitals must proactively analyze physician relationships, develop procedures for establishing new relationships and actively monitor current arrangements. This presentation addresses best practices to help standardize physician contracting within an organization and to increase compliance with both the Anti-Kickback Statute and the Stark Law.
