Patrick Garcia concentrates his practice on regulatory compliance issues with specific focus on health care fraud and abuse matters. Based in the firm’s Annapolis office, Patrick works with clients, including hospitals and health systems, to ensure compliance with the myriad of regulatory requirements within the health care industry.
Patrick’s fraud and abuse experience ranges from advising clients proactively on billing and compliance issues to providing counsel during government and internal investigations and audits. He provides guidance to compliance and legal departments, assisting compliance officers and in-house counsel with day-to-day challenges and ensuring a wide variety of arrangements, including physician relationships and joint ventures comply with the Anti-Kickback Statute and Stark Law. Patrick regularly counsels clients with respect to government investigations, including False Claims Act liability, Corporate Integrity Agreement negotiations and implementation, self-disclosures to the appropriate agency and HHS-OIG and CMS administrative actions, such as exclusion and revocation. Additionally, he works with clients to evaluate, develop, and bolster the effectiveness of their compliance programs by drafting and reviewing compliance policies and procedures, developing and providing Board level and compliance committee training, coordinating internal investigations and recommending corrective actions.
Prior to joining Hall Render, Patrick served as Senior Counsel in the Administrative and Civil Remedies Branch of the Office of Counsel to the Inspector General, U.S. Department of Health and Human Services. Having represented HHS-OIG in a wide range of civil and administrative health care fraud enforcement matters in coordination with the Department of Justice, the Centers for Medicare & Medicaid Services and the Food and Drug Administration, Patrick’s counsel is informed by his unique experience and perspective on health care fraud issues.
Patrick is actively involved in the American Health Law Association, where he currently serves as Vice Chair of the Young Professionals Council. He is a frequent speaker and author within the organization in addition to assisting in the planning and organization of educational content. Patrick is also an active member of the Health Care Compliance Association and has presented and authored for HCCA.
