Legal Reimbursement Update:60 Day Overpayment Rule and Recent Development with RACs

This presentation will discuss the new obligations and responsibilities created by the 60 day overpayment rule, which requires health care providers to return any overpayments within 60 days of identifying those overpayments.  It will identify potential areas of liability under the current proposed regulations and suggest precautions that can be taken to limit that liability. It will also address recent developments in state and federal audit activities including Recovery Audit Contractors.

Retention of Overpayments: New Rules and Responsibilities

This presentation assists health care providers in understanding the recently published proposed rule addressing the requirement that providers repay overpayments within 60 days of identifying the overpayments. The presentation addresses areas where the proposed rule places additional burdens and responsibilities on health care providers. Special emphasis is placed on continued areas of uncertainty particularly with respect to when the 60-day “clock” starts ticking.
