Scott Taebel represents clients nationally regarding a broad range of regulatory compliance matters including false claims, anti-kickback- and Stark-related concerns. He serves as the primary Compliance Counsel for many of the firm's clients. Mr. Taebel has extensive experience working with clients across the country regarding investigations coordinated through numerous federal and state enforcement agencies, including Main Justice, United States Attorney Offices, the Office of Inspector General, the Federal Bureau of Investigations, the Securities and Exchange Commission, State Attorneys General and Medicaid Fraud Control Units. Mr. Taebel also regularly assists clients in taking proactive strategies to identified compliance concerns through self-disclosures made to the Office of Inspector General, the Centers for Medicare & Medicaid Services, the Department of Justice and State Fraud Control Units and voluntary refunds of overpayments submitted to Medicare Parts A through D contractors and other payers. He has submitted over 150 different self-disclosures to OIG and CMS in helping a variety of providers come forward to resolve a wide range of identified false claims, anti-kickback and Stark compliance concerns. Mr. Taebel’s compliance work includes retail, specialty and institutional pharmacy internal investigations and self-reporting. He has also represented clients in government investigations concerning individual provider prescription practices, pharmacy billing protocols and pharmacy benefit manager pharmacy pricing questions. He further counsels firm clients regarding the functions of their corporate integrity programs, including coordinating internal investigations of compliance-related concerns, recommending corrective action, reviewing program effectiveness and providing compliance education and training of provider staff and Board members. Mr. Taebel also assists providers subject to corporate integrity agreements and other government-imposed mandatory compliance obligations. In 1994, Mr. Taebel argued a Medicare reimbursement appeal before the United States Supreme Court. He frequently publishes and presents on health care compliance-related topics.
