Hall, Render, Killian, Heath and Lyman is pleased to announce settlement with the Centers for Medicare and Medicaid Services (CMS), resulting in the largest Medicare payment settlement in history.

Hall Render and Baker Healthcare represented approximately half of the more than two thousand U.S. hospitals involved in this settlement.  The dispute centered on a payment calculation error made by CMS, resulting in annual underpayments to those hospitals for 11 years.  The error was the subject of a favorable decision on the issue (argued by another firm) at the United States Court of Appeals in Cape Cod Hospital et. al. v. Sebelius, in January of last year.  The Court of Appeals determined that CMS had underpaid hospitals, in violation of the Medicare statute.

This milestone settlement will result in payments to participating hospitals for the outstanding amounts to be made by June 30, 2012.  Receipt of back payments will allow these hospitals to continue to serve their communities in the current difficult financial environment.

Hall Render and Baker Healthcare collaborated with over 25 state hospital associations and other sponsoring entities, leading to the formation of hundreds of administrative appeals for this issue.  Finalizing this payment settlement allows clients to continue to provide quality care for their patients.  As a leading firm in Medicare and Medicaid payment law and regulations, Hall Render is proud to have the opportunity to assist clients during this important settlement.

Boguth practices in Hall Render's Health Information Technology section where he focuses on drafting and negotiating agreements for software development and licensing, IT consulting and other information systems.  Prior to joining the firm, he worked as an attorney for IBM.

Boguth completed his undergraduate studies at the University of Michigan, where he remained to earn his law degree.  While in law school, he was an editor of the Michigan Journal of Law Reform.

Boguth was admitted to the State Bar of Michigan in 2009.  He is a member of the Michigan Bar Association and American Health Lawyers Association.

Hall, Render, Killian, Heath and Lyman attorney Colleen M. Powers, J.D., was named Indianapolis Bar Association’s “2011 Young Lawyer of the Year.”

The Indianapolis Bar Association’s “Young Lawyer of the Year” award is given to an attorney who has demonstrated a commitment to advancing and serving the legal profession.

Powers focuses her practice on corporate transactional law, health care law and tax and tax-exempt law. She graduated from Indiana University Robert H. McKinney School of Law and completed the Health Law Concentration with honors. Powers is a member of the Indianapolis Bar Association's Board of Directors, serves as Chair of the Young Lawyers Division and is a graduate of the Indianapolis Bar Association's Bar Leader Series.

Dummett is a member of the Health Information Technology section of the Business/Tax practice group where he focuses on advising hospitals, health systems and physician organizations on corporate and health law-related matters, including regulatory and compliance, contracting and information systems. Dummett joined the firm after working as in-house counsel for IBM. While in law school, he interned at Winston and Strawn in Chicago, IL.

He graduated from Clarion University of Pennsylvania with a degree in Molecular Biology in 2007.  Dummett then earned his law degree from the Indiana University Maurer School of Law in 2010.

Dummett was admitted to the State Bar of Michigan in 2010. He is currently a member of the Michigan State Bar Association and American Health Lawyers Association.

Malone's Litigation and Risk Management practice focuses on the area of professional liability defense with a particular emphasis in defending lawyers, law firms, dentists, physicians and hospitals. He has also handled the defense of complex general liability matters involving catastrophic personal injury, wrongful death, premises liability and insurance coverage.

In 1999, Malone received his Bachelor of Arts degree from Indiana University, then his Juris Doctor from the Indiana University Robert H. McKinney School of Law in 2003. The same year he was admitted to the Indiana bar.

Malone has been in private practice since 2003, most recently with a national Chicago based law firm. Hanefeld focuses her practice on Litigation and Risk Management, with particular emphasis on litigation before Medical Review Panels and in courts throughout the state of Indiana.

Hanefeld completed her undergraduate degree with distinction in 1992 from Indiana University, and in 1996 received her Juris Doctor from the Indiana University Robert H. McKinney School of Law. In 2009, she was announced a Super Lawyers Rising Star in Indiana.

Executive Women in HealthCare (EWHC) took a field trip to the Indiana State House on March 23. Eric Wright, PhD, Professor and Division Director for Health Policy and Management at IUPUI, gave a brief presentation about reform and the impact it has on the State. The women then met with Senators Patricia Miller, Jean Leising and Vaneta Becker at the State House and observed the Senate Health and Provider Services Committee at work. Susan Bizzell and Allison Taylor, Hall Render attorneys, were instrumental in planning and executing this event. Susan, a member of the Board of Directors for EWHC and the Board Liaison to the Programs Committee, emceed the event and coordinated with the Senators and their staff. Allison spoke during the breakfast about process, prepared a summary of bills on the agenda, and generally helped EWHC navigate the State House.

The primary focus of Torossian's practice is in Health Care Business Transactional. Torossian has eight years of experience in private practice as well as two years of experience as the In-House Corporate Counsel at the Learning Care Group, Inc. and a year of experience as the Judicial Law Clerk to the Honorable Kaye Tertzag.

Torossian received her undergraduate Bachelors degree with honors from Wayne State University and her Juris Doctor at Wayne State University Law School, graduating with cum laude honors. She was admitted to the bar in both the state of Michigan and the U.S. District Court in the Eastern District of Michigan in 2000.

Torossian has co-authored two articles, "Transitioning to Home Care: Fraud and Kickback Issues" published by the Health Care Compliance Association and "Without Warning: Medicaid Wields Withholding" published by the American Health Lawyers Association. Hall Render Shareholder, Mark R. Lezotte was recently elected to the National Board of Trustees of United Cerebral Palsy Association.

Mark has been involved with United Cerebral Palsy (UCP) on a local and national level for over 15 years, including serving as board chair of the local affiliate, UCP of Metro Detroit. He was a recipient of the national chairperson's award in 2004, recognizing his volunteer work for UCP.

Mark practices in the firm's Troy, Michigan office. He has substantial experience in corporate, health care, tax, and exempt organization matters, including hospital-physician ventures, business acquisitions and dispositions, tax-exempt issues, regulatory investigations, corporate and nonprofit governance, and medical staff matters.

He has conducted presentations on a number of topics involving health law, nonprofit organizations, and tax matters.
