style='font-size:10.0pt;font-family: "Arial","sans-serif";color:#616459'>On June 2, 2010, 2009 Wis. Act 362 (the &quot;Act&quot;) took effect and directs the Wisconsin Pharmacy Examining Board (&quot;PEB&quot;) to establish a prescription drug monitoring program (&quot;PMP&quot;) to monitor the dispensing of Schedule II and Schedule III prescription drugs, as well as those prescription drugs identified by the PEB as having a substantial potential for abuse.&nbsp; The legislation is intended to prevent diversion of controlled substances and improve patient safety through more stringent prescription drug management efforts.&nbsp; Wisconsin, like many other states, has seen an increase in incidents involving prescription fraud and doctor shopping, as well as various prescription drug incidents involving Wisconsin health care providers in recent years.&nbsp; By passing this legislation, Wisconsin joins forty-one other states that have enacted PMPs.&nbsp; The changes are codified in Chapter 450 of the Wisconsin Statutes.<o:p></o:p></span></p> <div style='margin-top:12.0pt'> <p style='text-align:justify'><span style='font-size:10.0pt;font-family: "Arial","sans-serif";color:#616459'>Specifically, Section 1 of the Act, codified at Wis. Stat. § 146.82(1), confidentiality of patient health care records, to allow the reporting of records generated under Wis. Stat.&nbsp;§ 450.19.&nbsp;At the same time, the law is drafted to ensure the privacy of patients' medication history and to ensure that access to data is strictly limited.&nbsp;&nbsp;&nbsp;&nbsp;<o:p></o:p></span></p> <p style='text-align:justify'><span style='font-size:10.0pt;font-family: "Arial","sans-serif";color:#616459'>To implement the new PMP, the Act requires the Department&nbsp; of Regulation and Licensing (&quot;Department&quot;) to apply for a federal grant under 42 U.S.C. § 280g-3 and under the Harold Rogers Prescription Drug Monitoring Program to fund the establishment and operation of the PMP.&nbsp; In the event the Department fails to obtain federal funding by January 1, 2015, Wis.
