FMLA Forms Have Been Revised – Are Yours Up to Date?

As we reported in our February 12, 2013 HR Insights blog positing New FMLA Regs and New FMLA Poster – March 8, 2013, the new FMLA regulations made several changes to the provisions dealing with military servicemembers and their families.  Besides requiring a new FMLA poster that addresses these changes, the U.S. Department of Labor Wage-Hour Division has now updated its FMLA forms in order to comply with the new regulations. New FMLA Regs and New FMLA Poster – Finally

Over the past 5 years, the FMLA has been amended on several occasions. While the FMLA was amended most recently in late 2009 under the National Defense Authorization Act (“NDAA”) and the Airline Flight Crew Technical Corrections Act (“AFCTCA”), the U.S. Department of Labor Wage and Hour Division delayed in issuing proposed regulations until February 15, 2012.  Since that time, employers have been waiting on the issuance of final regulations.  The wait is now over.

On February 6, 2013, a Final Rule was issued and takes effect on March 8, 2013.  While most of the new regulations relate to rarely used FMLA provisions, including military caregiver leave for a veteran, qualifying exigency leave for parental care and job-protected leave for airline personnel and flight crews, there is one provision that all covered employers need to know about – and soon(more…)

Need Time? DOL Publishes FMLA Help for Employees…and Employers

In an effort to reach out to employees who may not be aware of their rights for a leave of absence under the FMLA, the U. S. Department of Labor has set up a webpage that contains a great deal of helpful information.  The information is contained in a downloadable 16-page booklet – “Need Time? The Employee’s Guide to the Family and Medical Leave Act“ and is focused on the questions that employees would generally raise about the FMLA.  (more…)

New (Old) FMLA Forms Approved Through 2015 – GINA Safe Harbor Is Still Missing

Many employers use the U.S. Department of Labor’s model FMLA forms as the basis of their paperwork in granting FMLA leaves.  Take a look at the top right hand corner of those forms.  It’s very likely that it says the form expires on December 31, 2011 (or even earlier).  In February the DOL issued new FMLA forms that will be good for use through February 28, 2015.  Interestingly, the newly authorized but  same old FMLA forms remain unchanged despite the need to include the GINA “Safe Harbor” language in all requests for medical information.  The “new” DOL FMLA forms can be accessed on the DOL website.
