Richard Davis focuses his practice on issues affecting the sourcing, delivery, dispensing and reimbursement of pharmaceuticals (particularly the 340B drug discount program), Medicare reimbursement appeals and electronic health record/general IT contracting issues. Richard also provides guidance on compliance issues such as physician arrangements, fraud and abuse, beneficiary inducement, excluded providers and other similar matters. In addition, he has worked with clients concerning the OIG and CMS self-disclosure process as well as other aspects of governmental investigations conducted through federal enforcement agencies.
Within the 340B drug discount program universe, Richard has assisted clients around in the country implement, monitor, and optimize their internal 340B drug discount programs. He has also assisted numerous clients in appealing and/or correcting adverse 340B drug discount program audit determinations by governmental agencies, which often involve complex legal and operational analyses.
Richard has also worked with various health care providers in appealing adverse determinations both before the Departmental Appeals Board and the Provider Reimbursement Review Board with a particular emphasis on issues related to critical access hospital determinations and reimbursement.
Finally, as a former Project Manager for Epic Systems, Richard is experienced in drafting and negotiating various contracts pertaining to electronic health records and general IT issues.
